Scope of this Privacy Policy

This Privacy Policy is incorporated by reference into the Terms of Use. The Privacy Policy explains how Electrum may collect, use, and disclose information that we obtain through the Website Service. This Privacy Policy applies to information we collect: (a) on the Website, (b) in email, text or other electronic messages between you and Electrum or between you and Electrum employees, and (c) through any other communication sources from us. It does not apply to information collected by (y) us offline or through any other means, including on any other website operated by us or any third party, or (z) any third party including through any application or content (including advertising) that may link to or be accessible from the Website.

The "Website Service" means the Website and any associated mobile applications and internet services under Electrum's control, whether partial or otherwise, in connection with providing the services of the Website.

"Personal Information" means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

1. The Website Service Collects Your Information

We collect Personal Information when you: (1.1) Register to use the Website Service; (1.2) Post it to the Website Service; (1.3) Make a payment; and (1.4) Communicate with us. Electrum may collect Personal Information. If you decide to choose any of the offered bids which are submitted by Installer Partners for your project to our Website, we may collect billing and credit card information. This information may be used to complete the purchase transaction.

Electrum may also collect anonymous demographic information, which is not unique to you, such as your age, gender, household income, financial status, credit scores, and/or building details. We may gather additional personal or non-personal information in the future.

Information about your computer hardware and software may be automatically collected by the Website. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the Website Service, to maintain quality of the Website Service, and to provide general statistics regarding use of the Website Service.

Electrum encourages you to review the privacy statements of websites you choose to link to from the Website so that you can understand how those websites collect, use and share your information. Electrum is not responsible for the privacy statements or other content on websites outside of the Website.

2. Use of your Personal Information

We use Personal Information to: provide and improve the Solar.com Service; and communicate with you. Solar.com does not sell, rent or lease its customer lists to third parties unless explicitly communicated to you and agreed upon by you in advance and only for the purposes explicitly stated. We may use aggregate information for any purpose, including for marketing purposes. Solar.com collects and uses your personal information to operate its website(s) and deliver the services you have requested.

Solar.com may also use your Personal Information to inform you of other products or services available from Electrum and its affiliates. Electrum may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered. Electrum may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique Personal Information is not transferred to the third party.

Solar.com may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Solar.com, and they are required to maintain the confidentiality of your Personal information.

Electrum may disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Electrum or the Website; (b) protect and defend the rights or property of Electrum; and (c) act under exigent circumstances to protect the personal safety of users of Electrum, or the public.

Mobile Messaging (SMS/Text)

If you provide your mobile phone number to us, we may send you text (SMS) messages in the following categories: (a) one-time passcodes and account verification / login codes; (b) transactional and service messages, including account updates, order and project status, appointment reminders, and other notifications related to services you have requested; and (c) marketing and promotional messages about our products, services, offers, and related electrification products. The sender of these messages is Pick My Solar Corp. dba Electrum ("Solar.com").

Consent basis. We send verification, account, and transactional messages on the basis of the prior express consent you give when you provide your number in connection with those services. We send marketing and promotional text messages only after you provide separate, prior express written consent (for example, by affirmatively checking a dedicated marketing-consent box). Your consent to receive marketing text messages is not a condition of purchasing any product or service, and you are not required to agree to marketing texts to use the Website, receive a quote, or speak with an advisor.

Message frequency and rates. Message frequency varies. Message and data rates may apply according to the terms of your mobile carrier. Carriers are not liable for delayed or undelivered messages.

Opt-out and help. You can opt out of text messages at any time by replying STOP (or UNSUBSCRIBE or CANCEL) to any message; we will stop sending marketing texts to that number. Opting out of marketing texts will not stop non-marketing service messages such as account, security, or verification messages that are necessary to provide services you have requested.

How we treat your mobile information. We do not sell, rent, or share your mobile phone number or your SMS/text-messaging consent (opt-in) with third parties or affiliates for their own marketing or promotional purposes. We may share your mobile number with service providers (such as our messaging platform and telecommunications carriers) strictly to deliver the messages you have asked to receive; those providers are prohibited from using your number for any other purpose. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

We retain records of the consent you provide (including a timestamp, the phone number, and the disclosure you agreed to) as required to demonstrate compliance with applicable law.

3. Cookies, Automatic Data Collection, and Related Technologies

The Website collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics. We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). (3.1) The information we collect automatically is statistical data but may include personal information; we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to: estimate our audience size and usage patterns; store information about your preferences, allowing us to customize our Website according to your individual interests; speed up your searches; and recognize you when you return to our Website.

(3.2.1) Cookies (or browser cookies). A "Cookie" is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website. For example, as you browse Solar.com, advertising cookies will be placed on your computer so that we can understand what you are interested in. Our display advertising partner, AdRoll, then enables us to present you with retargeting advertising on other sites based on your previous interaction with Solar.com. The techniques our partners employ do not collect personal information such as your name, email address, postal address or telephone number. (3.2.2) Flash Cookies. Certain features of our Website may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Website. Flash cookies are not managed by the same browser settings as are used for browser cookies.

(3.2.3) Web Beacons. Pages of our Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any Personal Information you provide to us. By using the Website Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Solar.com Service. By using the Solar.com Service, you will transfer data that will be stored in the United States or another jurisdiction to the extent permitted by law.
